Terms of Service
Wasaa is a prediction market for Kenya. You trade on the outcomes of real events in Kenyan shillings, paid in and out through M-Pesa. Please read these terms carefully: they explain your rights and ours.
1. About these terms
These Terms of Service (“Terms”) are an agreement between you and Wasaa Markets (“Wasaa”, “we”, “us”). They apply whenever you visit woza.markets, create an account, deposit, trade or withdraw. By creating an account or using the service you confirm that you have read and accept these Terms and our Privacy Policy.
We may update these Terms. When we make a material change we will let you know in the app before it takes effect. If you keep using the service after that date, the updated Terms apply.
2. Who can use Wasaa
- You must be at least 18 years old. We do not knowingly open accounts for anyone younger.
- You must be resident in Kenya and use a Kenyan mobile number registered in your own name.
- One account per person. Accounts may not be shared, sold or operated on behalf of someone else.
- You must not use Wasaa if doing so is unlawful where you are, or if you have self-excluded from gaming or prediction products.
- People with inside knowledge that could decide or reveal a market’s outcome before it is public must not trade that market.
3. Your account and security
You sign in with your phone number and a one-time code sent by SMS. Keep your phone, SIM and codes secure and never share a code with anyone, including people claiming to be Wasaa staff. You are responsible for activity on your account until you tell us it has been compromised.
We may ask you to verify your identity (for example with your national ID) before a withdrawal, when limits are reached, or where the law requires it.
4. How markets work
Each market asks a question about a future event with a Yes or No answer, or several possible answers. You buy shares in an outcome with Kenyan shillings (KES). The market page and the trade ticket show the current chance, what your stake returns if the outcome is correct, and any commission before you confirm.
Prices move as other people trade. The figures on the ticket are an estimate at the moment you look; the confirmed trade in your portfolio is the record of what you bought.
Wasaa does not give financial, legal or trading advice. Chances shown on the site reflect trading on the platform, not a prediction by Wasaa.
5. Resolution, disputes and cancellations
Every market publishes its resolution criteria and source on its page. When the outcome is known, the market is resolved against those criteria and the stated source, and each result is checked by a second reviewer before payouts are made.
If an event is cancelled, the question becomes impossible to answer, the source never publishes a result, or a market was opened in error, we may void it and refund stakes. If a market was resolved incorrectly we may correct the resolution and adjust the affected balances.
To dispute a result, contact support@wasaa.markets as soon as possible after resolution with the market link and your reasons.
6. Deposits, withdrawals and fees
- All balances and transactions are in Kenyan shillings.
- Deposits and withdrawals are made through M-Pesa, using a number registered in your name. Withdrawals are paid to that number.
- Minimum and maximum amounts for deposits, trades and withdrawals are shown in the wallet and on the trade ticket and may change from time to time.
- Wasaa may charge a commission on profits. It is shown on the trade ticket before you confirm a trade.
- Taxes that Kenyan law requires to be deducted from profits, including withholding tax, are deducted before profits are credited, and remitted to the Kenya Revenue Authority.
- M-Pesa is operated by Safaricom. Its own charges, limits and outages are outside our control.
We may delay or refuse a withdrawal while we complete identity or fraud checks, or where the law requires us to.
7. Fair use
You must not:
- open more than one account, or trade through someone else’s account;
- collude with other traders, or trade to manipulate a price or a result;
- trade on non-public information about how a market will resolve;
- use bots, scrapers or automated tools that disrupt the service;
- use the service to launder money or move proceeds of crime;
- abuse promotions, bonuses or referral rewards;
- harass other users or our staff.
If we reasonably believe you have broken these rules we may suspend trading, void affected trades, withhold profits that came from the breach, close your account, and report the matter to the relevant authorities.
8. Responsible trading
Trading on outcomes involves real risk. Only trade money you can afford to lose. 18+ only.
You can set deposit limits or self-exclude from your account safety settings at any time. A self-exclusion cannot be reversed before its period ends. If trading stops being fun, take a break and talk to someone you trust, or contact us for help closing your account.
9. Closing your account
You can ask us to close your account at any time. Any available balance will be paid to your registered M-Pesa number once open positions have resolved and any required checks are complete. Accounts with no activity for a long period may be treated as dormant, as permitted by Kenyan law, and we will try to contact you before doing so.
10. Availability and liability
We work to keep Wasaa available and accurate but cannot promise uninterrupted service. Trading may be paused for maintenance, security or legal reasons.
To the extent permitted by Kenyan law, Wasaa is not liable for losses from trading decisions you make, network or SMS outages, M-Pesa interruptions, or events outside our reasonable control. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2012 or other Kenyan law that cannot be excluded.
11. Governing law and contact
These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute that we cannot resolve together first.
